Terms used

"Pseudonymization" means the processing of personal data in such a way that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures ensuring that the personal data is not attributed to an identified or identifiable natural person.

"Profiling" means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person's work performance, economic situation, health, personal preferences, interests, reliability, behavior, location or movements.

"Controller" means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

"Processor" means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

Relevant legal bases

In accordance with Art. 13 GDPR, we inform you of the legal bases for our data processing. Where the legal basis is not stated in the privacy policy, the following applies: the legal basis for obtaining consent is Art. 6 (1) (a) and Art. 7 GDPR; the legal basis for processing to fulfill our services and carry out contractual measures as well as to respond to inquiries is Art. 6 (1) (b) GDPR; the legal basis for processing to fulfill our legal obligations is Art. 6 (1) (c) GDPR; and the legal basis for processing to protect our legitimate interests is Art. 6 (1) (f) GDPR. In the event that vital interests of the data subject or another natural person make the processing of personal data necessary, Art. 6 (1) (d) GDPR serves as the legal basis.

Security measures

In accordance with Art. 32 GDPR, taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing as well as the varying likelihood and severity of the risk to the rights and freedoms of natural persons, we take appropriate technical and organizational measures to ensure a level of protection appropriate to the risk.

These measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical access to the data as well as the access, input, disclosure, availability and separation relating to it. Furthermore, we have established procedures that ensure the exercise of data subjects' rights, the erasure of data and a response to threats to the data. We also take the protection of personal data into account as early as the development or selection of hardware, software and procedures, in accordance with the principle of data protection by design and by default (Art. 25 GDPR).

Cooperation with processors and third parties

Insofar as we disclose data to other persons and companies (processors or third parties) within the scope of our processing, transmit it to them or otherwise grant them access to the data, this is done only on the basis of legal permission (e.g. where a transmission of data to third parties, such as payment service providers, is necessary for the performance of a contract pursuant to Art. 6 (1) (b) GDPR), where you have consented, where a legal obligation provides for it, or on the basis of our legitimate interests (e.g. when using agents, web hosts, etc.).

Insofar as we commission third parties with the processing of data on the basis of a so-called "data processing agreement," this is done on the basis of Art. 28 GDPR.

Transfers to third countries

Insofar as we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)), or this occurs in the context of using third-party services or disclosing or transmitting data to third parties, this is done only to fulfill our (pre-)contractual obligations, on the basis of your consent, due to a legal obligation or on the basis of our legitimate interests. Subject to legal or contractual permissions, we process or have data processed in a third country only where the special requirements of Art. 44 et seq. GDPR are met.   • In accordance with Art. 17 GDPR, you have the right to request that data concerning you be erased without undue delay, or alternatively, in accordance with Art. 18 GDPR, to request a restriction of the processing of the data.
  • You have the right to request that the data concerning you which you have provided to us be received in accordance with Art. 20 GDPR and to request its transmission to other controllers.
  • You also have the right, pursuant to Art. 77 GDPR, to lodge a complaint with the competent supervisory authority.

You have the right to withdraw consent you have given, with effect for the future, pursuant to Art. 7 (3) GDPR.

Right to object

You may object to the future processing of data concerning you at any time in accordance with Art. 21 GDPR. The objection may in particular be made against processing for the purposes of direct marketing.

Cookies

Our website uses so-called cookies. These are small text files stored on your device with the help of your browser. They cause no harm. We use cookies to make our offering user-friendly. Erasure of data

The data we process is erased or its processing restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated within this privacy policy, the data stored by us is erased as soon as it is no longer required for its intended purpose and no statutory retention obligations prevent erasure. If the data is not erased because it is required for other legally permissible purposes, its processing is restricted. This means the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax reasons.

Under statutory requirements in Germany, retention is in particular for 10 years pursuant to Sections 147 (1) of the German Fiscal Code (AO) and 257 (1) nos. 1 and 4, (4) of the German Commercial Code (HGB) (books, records, management reports, accounting documents, commercial books, documents relevant for taxation, etc.) and for 6 years pursuant to Section 257 (1) nos. 2 and 3, (4) HGB (commercial letters).

Under statutory requirements in Austria, retention is in particular for 7 years pursuant to Section 132 (1) of the Austrian Federal Fiscal Code (BAO) (accounting documents, receipts/invoices, accounts, vouchers, business papers, statements of income and expenditure, etc.), for 22 years in connection with real estate, and for 10 years for documents relating to electronically supplied services, telecommunications, broadcasting and television services provided to non-business customers in EU member states for which the Mini One Stop Shop (MOSS) is used.

Contacting us

When you contact us (e.g. via contact form, email, phone or social media), the user's details are processed for the purpose of handling the contact inquiry and its processing pursuant to Art. 6 (1) (b) GDPR (within the scope of contractual/pre-contractual relationships) and Art. 6 (1) (f) GDPR (other inquiries). Users' details may be stored in a customer relationship management system ("CRM system") or comparable inquiry organization.

However, your accommodation, seminar or general inquiry can only be transmitted to us electronically if you expressly agree to this privacy and data use statement by clicking on it.

We erase inquiries once they are no longer required. We review the necessity every two years; statutory archiving obligations also apply.

You have the option of subscribing to our newsletter via our website. For this we require your email address and your declaration that you agree to receive the newsletter. Matomo runs on the servers of Cookis GmbH, 6460 Imst, Franz Xaver Rennstraße 4 (Bakehouse customers). Cookies are used for this purpose, which enable an analysis of the use of the website by its users. The information generated is transmitted to the respective providers' servers and stored there.

You can prevent this by setting up your browser so that no cookies are stored. Your IP address is recorded but immediately pseudonymized by deleting the last eight bits. As a result, only an approximate localization is possible.

Data processing is carried out on the basis of the statutory provisions of Section 96 (3) of the Austrian Telecommunications Act (TKG) and Art. 6 (1) (a) (consent) and/or (f) (legitimate interest) GDPR.

Our concern within the meaning of the GDPR (legitimate interest) is the improvement of our offering and our web presence. Since the privacy of our users is important to us, user data is pseudonymized.

Hosting and email dispatch

The hosting services we use serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, email dispatch, security services as well as technical maintenance services that we use for the purpose of operating this online offering.

In doing so, we and/or our hosting provider process master data, contact data, content data, contract data, usage data, meta and communication data of customers, prospective customers and visitors to this online offering on the basis of our legitimate interests in the efficient and secure provision of this online offering pursuant to Art. 6 (1) (f) GDPR in conjunction with Art. 28 GDPR (conclusion of a data processing agreement).

Web server log

For smooth operation and, where necessary, troubleshooting, websites generally have logs on the web server where IP addresses are stored. Like many other companies, we operate our website via the servers of a professional service provider. Although IP addresses alone do not constitute personal data, they could theoretically be attributed to individuals with the help of tracking tools. In addition, the time, the browser type and the page visited are stored. These logs are deleted after one month.

Data storage

We point out that, for the purpose of a simpler purchasing process and subsequent contract processing, the web shop operator stores the IP data of the connection holder within cookies, as well as the name, address and credit card number of the buyer.

The data you provide is required for the performance of the contract or for carrying out pre-contractual measures. Without this data, we cannot conclude the contract with you. No data is transmitted to third parties, with the exception of the transmission of credit card data to the processing banks/payment service providers for the purpose of debiting the purchase price, to the transport/shipping company we have commissioned for the delivery of the goods, and to our tax advisor for the fulfillment of our tax obligations.

If the purchasing process is cancelled, the data stored by us is deleted. In the event that a contract is concluded, all data from the contractual relationship is stored until the expiry of the statutory tax retention period (7 years).

The data name, address, goods purchased and date of purchase is additionally stored until the expiry of product liability (10 years). Data processing is carried out on the basis of the statutory provisions of Section 96 (3) TKG and Art. 6 (1) (a) (consent) and/or (b) (necessary for the performance of the contract) GDPR.

Google Analytics

On the basis of our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offering within the meaning of Art. 6 (1) (f) GDPR), we use Google Analytics, a web analytics service provided by Google LLC ("Google"). Google uses cookies. The information generated by the cookie about users' use of the online offering is generally transmitted to a Google server in the USA and stored there.

Google is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google will use this information on our behalf to evaluate users' use of our online offering, to compile reports on the activities within this online offering and to provide us with further services associated with the use of this online offering and internet use. Meta Pixel with advanced data matching [UPDATE]

Within our online offering, we use the "Meta Pixel" service in advanced data matching mode, provided by Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland ("Meta").

When a user clicks on an advertisement we have placed on Facebook or Instagram, "Meta Pixel" adds a parameter to the URL of our linked page. After the redirect, this URL parameter is entered into the user's browser by a cookie that our linked page sets itself. In addition, this cookie records specific customer data, such as the email address, that we collect on our website linked to the Facebook or Instagram ad during processes such as purchases, account logins or registrations (advanced data matching).
